Organisations and individuals supplying or offering to supply second hand electrical equipment should be aware of the important legal obligations imposed on them under electricity safety legislation; as follows:

A person supplying or offering to supply second hand electrical equipment must have a label attached to the equipment stating that the equipment is second hand.

A business – including major charitable organisations – supplying or offering to supply second hand electrical equipment must also attach a label stating that the equipment is second hand and that the equipment has been inspected and tested and that it complies with Australian/New Zealand Standard(AS/NZS) 3760 - In-service safety inspection and testing of electrical equipment and AS/NZ 5761: 2005 - In-service safety inspection and testing of electrical equipment - second hand electrical equipment prior to sale.

If the item does not comply with the testing criteria, the business supplying or offering to supply second hand electrical equipment must include a clear statement on the label, stating the equipment is second hand, with additional words as follows: WARNING DO NOT USE UNTIL REPAIRED. If the organisation still wishes to sell the item in its defective state the provisions of AS/NZ 4701 - requirements for domestic electrical appliances and equipment for reconditioning or parts recycling, shall apply
